As per tradition, The Native Sun is reprinting here the City Ordinances pertaining to the proper sale and discharge of fireworks.
The following message is a personal one from your (hopefully) favorite editor, not laws, but perhaps they should be: As always, please use good common sense while enjoying your holiday festivities. Be mindful of veterans or others with PTSD in your area. If you suspect the ruckus might cause them distress, please ask if they would prefer you discharge your explosive devices elsewhere—and then do it. State Farm doesn’t have a monopoly on being a good neighbor. You can do it too!
Lastly, if you have a pet, PUT THEM INSIDE! They have no idea what is happening and the concussions, booms, and crackles terrify them. Every year, dogs are lost forever because they’ve run away from the noise. Some of them get disoriented and don’t find their way home. Others are run over and killed. Be responsible. Don’t be selfish.
Now, your ordinances:
Sec. 14-105 – Sale of Fireworks:
(a) Pyrotechnic devices classified and labeled as Class C fireworks (common fireworks) by the United States Department of Transportation (DOT) or Interstate Commerce Commission (ICC), under 49 CFR 173.100 (1977), may be sold, manufactured, possessed, transported or otherwise permitted for use in the city unless specifically prohibited by law. Prohibited devices may be used for public display purposed as provided for in K.A.R. 22-6-10 and may be possessed and transported by wholesalers and manufacturers for ultimate disposition outside the state.
(b) No person, partnership, firm, corporation, limited liability company or other business entity shall sell fireworks to individuals at temporary retail stands or other locations, deliver retail fireworks purchased by mail order before June 27 and after July 5. (Ord. No. 2004-08 § 2, 12-20- 2004)
Sec. 14-107 – Discharge of Fireworks:
No person shall ignite or discharge fireworks:
(1) Within 1,000 feet of any hospital, medical or dental clinic, mental health care facility, or long-term nursing care facility.
(2) Within, into, under, or on a car or vehicle, whether moving or standing still.
(3) From or onto a public street, road, highway, or the right of way adjoining a public street, road, or highway.
(4) Within 50 feet of any retail fireworks stand or facility where fireworks are sold or stored.
(5) Between the hours of 11:00 p.m. and 12:00 noon.
(6) After July 5 and before July 3 of the year following. (Ord. No. 2004-08, § 4, 12-20-2004)
